Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Humaine Technologies Inc., the seller and operator of MotionBrief (the "Seller", "we", "us"). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account, you represent that you are of legal age to form a binding contract and are authorized to use the service in your jurisdiction.

2. Service Access & Account Integrity

  • Account Security: You are responsible for all activity occurring under your account. Please keep your login credentials secure.
  • Acceptable Use: You agree not to use MotionBrief to transmit harmful code, interfere with service security, or engage in any unlawful activities.
  • Termination: We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion.

3. Subscription & Billing

  • Merchant of Record: Our order process is conducted by our online reseller Paddle.com Market Limited ("Paddle"). Paddle is the Merchant of Record for all our orders and is responsible for handling payments, billing, tax compliance, subscription management, customer service inquiries related to billing, and refunds. By purchasing a subscription you also agree to Paddle's Buyer Terms.
  • Payment Terms: Fees for our tiers (Plus and Pro) are billed in advance on a monthly or annual basis. Subscriptions automatically renew until cancelled.
  • Billing Management: All payment updates, invoice downloads, subscription changes, and cancellations are managed through the secure Paddle customer portal accessible from your account settings or at paddle.net.
  • Refunds & Cancellations: You may cancel your subscription at any time. We offer a 30-day money-back guarantee on new subscriptions — see our Refund Policy for full details. Refunds are processed by Paddle as Merchant of Record.
  • No Per-Participant Fees: Your subscription covers the features specified in your plan; there are no hidden per-participant or per-response fees.

4. Intellectual Property

All software, designs, trademarks, and documentation provided by MotionBrief are the exclusive property of MotionBrief. You are granted a limited, non-exclusive license to use the service for its intended scheduling and coordination purposes.

5. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, MotionBrief is not liable for indirect, incidental, or consequential damages arising from the use of our platform. Our total aggregate liability is limited to the fees you paid for the Service in the twelve (12) months preceding any claim.

6. Modifications

We may update these Terms from time to time. Your continued use of MotionBrief following any updates constitutes your acceptance of the new Terms.

7. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Any disputes arising from these Terms shall be resolved in the courts located in or having jurisdiction over Vancouver, British Columbia.
